1.1 “Services” refers to audio recording, audio mixing, audio post-production, music production, audio management, courses, AI specialist.
1.2 “Customer” refers to any individual or entity purchasing or using our Services.

1.4 “Consumer” refers to individuals acting for purposes outside their trade, business, craft, or profession.
2. Applicability
These Terms and Conditions apply to all sales, offers, and agreements concluded between Horace Production and its Customers through remote means, such as online platforms or email communication.
For EU Residents: These Terms comply with the Consumer Rights Directive (Directive 2011/83/EU) and the General Data Protection Regulation (GDPR).
For Non-EU Residents: While we strive to uphold high standards of consumer protection globally, non-EU Customers may be subject to varying local consumer laws. In case of conflict, EU law shall apply for EU residents, and local laws for non-EU Customers.
3. Contract Formation
3.1 All product or service listings on our Site constitute an invitation to make an offer.
3.2 A contract is formed only when we confirm your order via email or other written communication.
4. Prices and Payments
4.1 Prices listed on the Site include VAT for EU Customers but may exclude applicable taxes or duties for non-EU Customers.
4.2 Payment must be made through the methods indicated on the Site at the time of purchase.
4.3 Non-EU Customers are responsible for any customs duties, taxes, or fees applicable in their region.
5. Right of Withdrawal (EU Customers Only)
5.1 Under EU law, Consumers have a 14-day right to withdraw from a purchase without giving a reason.
5.2 Exceptions to this right include:
Services fully performed with the Customer’s prior consent.
Digital content delivered electronically if performance has begun with the Consumer’s prior express consent.
5.3 To exercise your right, you must notify us at max@horaceproduction.com within the 14-day period.
6. Liability
6.1 We are not liable for indirect or consequential damages arising from your use of our Services.
6.2 For EU Customers: Liability is governed by applicable EU laws, including mandatory consumer protection laws.
6.3 For non-EU Customers: Liability will be limited to the maximum extent permitted by applicable local laws.
7. Privacy and Data Protection
7.1 For EU Customers, we process personal data in accordance with the GDPR.
7.2 Non-EU Customers agree to our Privacy Policy, which aligns with global standards but may not fully comply with local data protection laws.

8. Intellectual Property
All content on the Site, including but not limited to text, graphics, and logos, is the intellectual property of Horace Production. Reproduction, distribution, or modification of any content without prior consent is prohibited.
9. Dispute Resolution
9.1 For EU Customers: Disputes will be governed by Italian law, except as otherwise provided by Regulation (EC) No. 593/2008 of 17 June 2008 on the law applicable to contractual obligations (Rome I). This choice of law does not affect the Customer's right to the protection granted by the consumer protection laws applicable in their country of residence, in cases where the Customer is a consumer residing abroad..
Consumers may also use the Online Dispute Resolution (ODR) platform provided by the European Commission.
10. Changes to the Terms
We may revise these Terms periodically. Changes will be posted on the Site, and continued use of our Services constitutes acceptance of the updated Terms.
